General Terms & Conditions of Sales

ARTICLE 1 – SCOPE AND ENFORCEABILITY

1.1 These general terms and conditions of sale (hereinafter the « GTC ») apply in their entirety and constitute the conditions of any offer and sale of cosmetic products and accessories (hereinafter the « Products »), offered by the company LMD Beauty EU (hereinafter the « Seller » or « we »), to any consumer customer, of legal age on the date of purchase on the site or a minor, emancipated or providing proof of authorization signed by his legal representative, residing in metropolitan France (hereinafter the « Customer » or « you »), on the website https://salonista.fr/ (hereinafter the « Site »).

1.3 You can consult the General Terms and Conditions of Sale at any time on the Site by clicking on the « General Terms and Conditions of Sale » tab at the bottom of the Site’s homepage https://salonista.fr/. The applicable General Terms and Conditions of Sale are those in effect at the time of your commande on the Site.

ARTICLE 2 – ORDERING PRODUCTS

2.1 Creating a Customer Account

To commande Products on the Site, you must have a Customer account. To do so, you can complete the form accessible in the « Create an account » section of the Site, fill in the fields marked with an asterisk and click on « Create a new account ».

You agree to provide accurate and up-to-date information regarding your identity and address and to update it in the event of any changes, including changes to your email address or postal address.

The Client is informed and agrees that the entry of any identifier constitutes proof of their identity and signifies their consent.

2.2 Product Selection

You can browse the tabs dedicated to Product categories on the Site and voir Product details by clicking on a Product page. To add a Product to your cart, you must select the quantity and size of the Product, if applicable, before clicking « Add to Cart, » subject to availability indicated by the « Product available » message, where applicable.

Each Product is accompanied by a description on the Website. The Customer is required to consult the description sheet for each Product to learn about its characteristics.

2.3 Product Prices

Product prices are listed on each product page on the Site, inclusive of all taxes. Prices shown on the product page on the Site do not include livraison charges, which are displayed when you select a méthode de livraison.

The prices are those in effect at the time the Customer places the Order.

The Seller may modify the selling prices of the Products at any time. However, price modifications will not apply to Orders placed by the Customer prior to said modification.

2.4 Viewing the summary of products added to the cart

Once you have selected the Products, you can voir the items in your cart by clicking on « My Cart ». The cart summary allows you to add quantities of Products or remove selected Products, then click on « Mettre à jour le panier » or continue shopping by clicking on « Complete My Order ».

To continue your commande of Products:
• If you do not already have a Customer account, you are invited to create one by clicking on « Create an account »;
• If you already have a Customer account, you are invited to log in by entering your username and password and clicking on « Log in » or you can also choose to continue shopping in guest mode (in this case, we will ask you for your livraison details and an email address to contact you).

2.5 Choice of méthode de livraison and livraison costs

You can then enter a discount code if you have one and must then fill in the information relating to the billing address, adresse de livraison, méthode de livraison and chosen payment method before checking the summary of your commande, then click on « Proceed to the next step ».

You can then choose home livraison or collection of the ordered Products at the store of your choice or at a relay point depending on our partners.

2.6 Order Confirmation

  1. To register your commande, you must:
    • verify the summary of selected products (quantities, references, and prices);
    • accept these Terms and Conditions by checking the box « I accept the Terms and Conditions » after reading them via the provided hyperlink;
    • review our Privacy Policy.
    You must then click « Finalize my commande » before proceeding to payment.

2.7 Payment for your commande

To proceed with payment, you will be redirected to the secure Cyberplus Payment website and must select the type of bank card you wish to use.
You guarantee that you have all the necessary authorizations to pay for your commande with the bank card used. You must enter your bank card information and click « Validate. » Payment of the commande confirms its validity.

When a purchase and payment is made on the Site, the Customer’s bank details are deleted once the transaction is terminé and archived for a maximum of 13 months as evidence in the event of a payment dispute. To ensure the security of payments made on the Site, we use the services of a payment provider, Cyberplus Payment, whose payment pages use the TLS protocol and are PCI-DSS certified. The PCI-DSS standard is an international security standard for protecting the confidentiality and integrity of cardholder data (card and transaction data).

2.8 Order Confirmation

Once your commande has been validated, you will receive an email at the address provided when creating your Customer account, containing the commande summary, the temps de livraison, and these Terms and Conditions.

ARTICLE 3 – GENERAL TERMS AND CONDITIONS OF SALONISTA SUBSCRIPTION

These terms and conditions govern your participation in the Abonnement on the website salonista.fr.
The abonnement allows you to receive the selected products chaque mois.

3.1 Products eligible for abonnement

The LMD Beauty EU abonnement applies only to a selection of products from specific brands. These products are clearly identified on their product page

3.2 Abonnement to a abonnement

By ticking the box when subscribing, you expressly accept the terms of these general conditions.

The Customer can choose the frequency of their abonnement directly on the product page from the following options: chaque mois, tous les 2 mois or tous les 3 mois.

If the customer subscribed to a Salonista Abonnement using a promotional code on their first commande, this discount will not be carried over to subsequent renewals.

Any commande validated by the Customer and confirmed by the Seller constitutes the formation of a distance contract between the Customer and the Seller.

The monthly abonnement fee is paid by direct debit from the Client’s bank account, with the exception of the first payment. The Client is notified of the direct debit when the commande is confirmed.

Payments are made according to the frequency chosen when subscribing, and will continue until the abonnement is annulé or modified.

The Customer can voir their détails d’abonnement, terms and conditions, and all orders on the « Account » page. They can also manage their abonnement information, such as payments and adresse de livraison, directly on this page.

3.3 Abonnement Conditions

A 5% discount is applied to the price of eligible products provided that a minimum abonnement commitment of two months is respected (a commitment of at least two orders)

3.4 Rates

The prices shown are those in effect on the Site at the time of abonnement. All prices are inclusive of all taxes, including the VAT applicable on the date of the commande.

3.5 Duration and termination

The abonnement is for a minimum duration of two cycles depending on the chosen frequency:

  • 2 months for a monthly abonnement,
  • 4 months for a abonnement tous les 2 mois,
  • 6 months for a abonnement tous les 3 mois.

The abonnement cannot be annulé before the end of this period. Once this period has expired, the Customer may annuler their abonnement at any time, without additional charges.
It is specified that any mois of abonnement begun is due in full, and no refunds will be issued for months already in progress.

3.6 Product Availability

In the event of a product being out of stock, if it is not restocked and shipped within 7 days of the originally scheduled date de livraison, the abonnement linked to that product will be automatically annulé.

ARTICLE 4 – COLLECTION OR DELIVERY OF PRODUCTS

4.1 Product Collection (where the option is available in your region)

When the option is available near your chosen pickup location as indicated on the Website, you can select in-store pickup. In this case, the ordered Products will be available to you within a maximum of 30 business days from the date of your commande on the Website (i.e., after payment confirmation on the Website), at the nearest store, during opening hours. You will be notified by telephone when your ordered Products are available for pickup at the store.

In commande to collect Products ordered on the Site in store, you must present an identity document (identity card, residence permit, passport or driving licence).

4.2 Home Livraison

For home livraison, a livraison charge, which is your sole responsibility, will be added to the price of the ordered Products. Livraison is carried out by [to be terminé], in mainland France, Corsica, and the French overseas departments and territories.

The livraison fee amount is indicated on the Site when you place your commande.

If you are not home at the time of livraison to the address you provided, a livraison notice will be left in your mailbox. You can then collect the package from a post office within 15 days of the date of this notice. If you exceed this timeframe, the package will be returned to LMD Beauty EU.

Customer service will then contact you regarding possible reshipment at your request and expense. If we do not receive a response from you within 30 days, we will issue a refund. Unless otherwise stated on the Website and subject to product availability, you will receive the products within a maximum of 30 business days.

 

ARTICLE 5 – RIGHT OF WITHDRAWAL

When you receive a Product, you have the option to exercise your right of withdrawal and return the Product that does not suit you.

5.1 Exercising your right of withdrawal

If you simply wish to return a Product ordered on the Site, you have 14 (fourteen) clear days from the day of collection of the Products in store or of receipt of the Products at your address to withdraw, by sending us the withdrawal form below or a letter of withdrawal (mentioning the information listed in the withdrawal form below):

When the withdrawal period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.

5.2 Returning Products

Once you have informed us of your intention to withdraw, you have 14 days to return the Products to LMD Beauty EU, according to one of the following options:
• either, by returning them in person to the store from which you collected the Product;
• or, by returning them by post to the following address: LMD BEAUTY EU 4 Rue de la République 69001 Lyon.

The Customer will bear the costs of returning or refunding the Products in question.

We reserve the right to refuse the exercise of the right of withdrawal to any Customer who has returned or given back one or more items whose value has been depreciated due to handling other than that necessary to establish the nature and characteristics of the Products.

5.3 Refund in case of withdrawal

We will refund the full price paid for the returned or remboursé Product(s) and livraison charges (excluding return shipping costs) on the earlier of the following two dates: the date we receive the returned Product(s) or the date the Customer provides proof of shipment or return.
The refund will be issued using the payment method you selected when placing your commande on the Website.

ARTICLE 6 – OBJECTION TO TELEPHONE SOLICITING

When you register on the Site, we collect your telephone number, particularly to inform you when Products are available in store or when your commande has been shipped. Your telephone number is not shared with our partners, with the exception of our shipping carrier.
You have the option to opt out of telemarketing calls from any professional by registering on the Bloctel opt-out list via the following link: https://conso.bloctel.fr/index.php/inscription.php. This registration is free and allows you to block telemarketing calls from professionals if you are registered on this list.

ARTICLE 7 – LEGAL GUARANTEES APPLICABLE TO THE PRODUCTS

The Seller is liable for defects in conformity of the Product to the contract under the conditions of Article L.217-4 et seq. of the Consumer Code and for hidden defects in the thing sold under the conditions provided for in Articles 1641 et seq. of the Civil Code.

When acting under the legal guarantee of conformity, the consumer:
• benefits from a period of two years from the livraison of the goods to act;
• can choose between repair and replacement of the goods, subject to the cost conditions provided for in Article L.217-9 of the Consumer Code;
• is exempt from providing proof of the existence of the lack of conformity of the goods during the twenty-four months following livraison of the goods.

The consumer may choose to invoke the warranty against hidden defects in the item sold, as defined in Article 1641 of the Civil Code. In this case, the consumer may choose between rescinding the sale or obtaining a reduction in the sale price, in accordance with Article 1644 of the Civil Code.

ARTICLE 8 – PERSONAL DATA

When you browse the Site or commande Products on the Site, we collect personal data about you. This data is used under the conditions set out in our Privacy Policy, which we encourage you to read (https://salonista.fr/politique-de-confidentialite).

ARTICLE 9 – COMPLAINTS AND DISPUTE RESOLUTION

These terms and conditions are governed by French law. In the event of a dispute, you have the option of using a free, conventional mediation procedure.

For this purpose, you can contact the following mediator: https://medicys.fr/. The procedures for contacting this mediator are available on their website.

To use this mediation procedure, you must first send your complaint to LMD Beauty EU by registered letter with acknowledgment of receipt. If you do not receive a satisfactory response within one mois, you may contact the mediator according to the procedures outlined on their website.

This mediation is optional, confidential and free of charge, with the exception of any lawyer or expert fees which will remain your responsibility.

The dispute cannot be examined by the mediator when:
• you do not provide evidence of having first attempted to resolve your dispute directly with LMD Beauty EU through a written complaint;
• the request is manifestly unfounded or abusive;
• the dispute has already been examined or is currently being examined by another mediator or by a court;
• you submitted your request to the mediator more than one year after your written complaint to LMD Beauty EU;
• the dispute falls outside the mediator’s jurisdiction.

If the outcome of the mediation is not satisfactory to you or if you do not wish to resort to a mediation process, you may, at your option, bring the matter before the competent courts in the jurisdiction of LMD Beauty EU’s registered office or the competent courts in the jurisdiction of your home.
